El Gobierno reglamentó la ley de cannabis medicinal y cáñamo industrial
La medida se formalizó 15 meses después de su sanción en el Congreso, el 5 de mayo de 2022.
La norma publicada hoy establece el funcionamiento de la Agencia Regulatoria de la Industria del Cáñamo y del Cannabis Medicinal (Ariccame), del Consejo Federal para el Desarrollo de la Industria del Cáñamo y Cannabis Medicinal y del Consejo Consultivo Honorario, que estará integrado por 20 miembros titulares e igual número de suplentes, de actuación ad honorem.
Al celebrar la iniciativa, el presidente de la Ariccame, Francisco Echarren, dijo que el nuevo marco “es pionero y de vanguardia a nivel mundial” y reafirmó que la industria “va a generar en el corto plazo diez mil empleos distribuidos federalmente”.
Entre las ventajas de la nueva reglamentación, Echarren ponderó “el límite de 1 % de THC que van a tener las plantas y derivados de cannabis dentro de la industria”, ya que “va a ensanchar muchísimo la industria, va a bajar los costos y va a permitir la expansión de la oferta”. En otros países los topes oscilan entre el 0,2 y el 0,5 %.
En una entrevista con la revista especializada THC, el funcionario explicó que elevar el límite fue una gran conquista porque el 0,5 % “dejaba muy estrecha la industria. No solo iba a haber cannabis más caro por una cuestión de costos, sino que se iba a concentrar el sector porque no todos pueden cumplir con esa normativa”.
La nueva ley también establece la adopción del sistema de ventanilla única para la gestión de trámites vinculados a la emisión de autorizaciones, licencias y certificaciones necesarias.
La ventanilla única va a concentrar en un solo lugar todas las gestiones que deben realizar los interesados en desarrollar la actividad.
Al respecto, Echarren afirmó que “con la ventanilla única vamos a simplificar la burocracia para facilitarle la vida a los que van a emprender, a invertir, a crear laburo y a generar la oferta para un enorme mercado que hoy existe pero no está regulado”.
En la reglamentación de la ley se determinó que la Ariccame, la entidad que conduce Echarren, será “el organismo competente para reglar, controlar y emitir las autorizaciones administrativas con respecto al uso de semillas de la planta de cannabis, del cannabis y de sus productos derivados”.
El marco regulatorio abarca a “la cadena de producción y comercialización nacional o con fines de exportación de la planta de cannabis, sus semillas y sus productos derivados afectados al uso medicinal, incluyendo la investigación científica, y al uso industrial; promoviendo así el desarrollo nacional de la cadena productiva sectorial”, indica la ley en su primer artículo.
En esa línea, el funcionario destacó el potencial en sectores como el cosmetológico, el alimenticio y el veterinario.
Según los plazos proyectados por el titular de Arricame, las primeras licencias para poder operar se entregarán “en dos meses, si todo sale bien”.
Asimismo, el funcionario indicó que “a mediados del próximo año deberían estar los primeros productos disponibles para las personas que los necesiten”.
Al presentar la ley en mayo del año pasado en un acto en Casa Rosada, el presidente Alberto Fernández la consideró “un paso en el acceso al derecho a la salud” y, a la vez, “un triunfo de la sociedad contra la hipocresía”.
En esa línea, Echarren manifestó que la iniciativa “ le va a dar una respuesta a millones de argentinos que necesitan usar cannabis medicinal o alguno de los derivados industriales del cáñamo y ahora lo están haciendo en un mercado absolutamente irregular sin ningún tipo de seguridad sanitaria”.
“La industria del cáñamo y el cannabis medicinal es un tema importante para agenda del futuro que genere empleo, desarrollo económico e inclusión en Argentina. Va a generar en el corto plazo diez mil empleos distribuidos federalmente con un fuerte enfoque en el desarrollo de las economías regionales, con lo cual en poblaciones chicas va a tener un impacto enorme”.
