Un argentino viajó con marihuana medicinal por varios países de Europa gracias al Reprocann
El Registro del Programa de Cannabis (Reprocann) procura mejorar el acceso a quienes tienen indicación médica basada en la evidencia científica disponible, a un producto como especialidad medicinal; con formulación magistral; o que se origine en un cultivo controlado de la planta de cannabis realizado por los pacientes para sí, por terceros, o por una red de pacientes asistidos.
En este caso Piero, especialista en derecho público internacional y fundador de Liebman & Asociados Abogados, un estudio jurídico especializado en regulaciones sobre cannabis, viajó a Barcelona el 10 de marzo para participar de la Expo Spannabis, una de las mayores ferias canábicas del mundo, con 40 gramos de flores secas y 10 de extracción.
“La idea del viaje surgió a partir del vínculo estrecho que se está forjando entre Europa y Argentina en torno al avance normativo que estamos teniendo en el país, cada vez hay más empresas interesadas en llegar y tengo varios clientes allá”, dijo Liebman a Télam desde Berlín, donde finalizó su viaje europeo.
El abogado contó que antes de viajar realizó una investigación sobre las leyes que tienen los países europeos sobre el cannabis y los acuerdos bilaterales con Argentina.
“Lo que hice fue averiguar cuáles eran las regulaciones de España, luego contacté al Consulado en Argentina y me dijeron que tenía que ir con el Reprocann y la receta médica. Ellos recomendaron consultar en la Agencia Tributaria, que es el organismo que regula qué entra y qué no. Luego llamé al puesto de control del aeropuerto para sacarme la duda e ingresé a España vía Uruguay sin ningún problema”, explicó.
“Buscaba hacer valer el Reprocann como parte de nuestro derecho a la salud, que es un derecho humano y que tiene que respetarse en todos los países con los que tenemos acuerdo en estas temáticas, y España es uno de ellos”, aseguró Liebman.
Desde marzo de 2021 el Ministerio de Salud creó el Reprocann, un registro para consumidores y cultivadores medicinales de cannabis para que puedan acceder a un cultivo controlado de la planta, con fines de tratamiento medicinal, terapéutico y/o paliativo del dolor.
Cualquier médico y odontólogo con matrícula vigente puede prescribir cannabis, el certificado aprobado por la cartera sanitaria autoriza a tener hasta 9 plantas en floración por paciente y permite transportar hasta 40 gramos de flores secas o 6 unidades de goteros de 30ml.
Después de Barcelona, Liebman viajó hacia Berlín, con escala en Londres, en un viaje que no tenía planeado. Si bien investigó e intentó llamar a las autoridades, no estaba seguro de las regulaciones pero “no quería quedarse con la duda”.
“Salí de España con las flores y llamaron a la policía. Les dije que soy usuario medicinal de cannabis y me llevaron a un costado, fue una situación muy incómoda donde yo mostré todos los permisos. Me decían que no podían comprobar si mi receta era real o no y me pedían documentación que ni ellos sabían cuál era. Luego me dejaron ir y me fui a Londres“, relató.
“Cuando llegué a Londres fui directamente a los policías que estaban en el control fronterizo y les dije que tenía cannabis y que no quería ningún tipo de problema. Nuevamente me llevaron para un costado y me dijeron que a cualquier persona que encontraban con marihuana la tenían que llevar detenida inmediatamente, pero este caso era especial porque no me la encontraron sino que yo fui y les avisé, era una situación que no sabían qué hacer“, siguió su relato Liebman.
El abogado argentino destacó que los policías ingleses “se comportaron de manera muy amable”, y tras demorarlo unos minutos concluyeron que no estaba haciendo ninguna contravención y que lo iban a escoltar hasta el avión para explicarle la situación a la aerolínea y a la policía de frontera.
“Fui escoltado por dos policías y en la aduana me revisaron hasta el último pelo. Me dijeron que me acompañaban hasta el avión porque la aerolínea es privada y tenían la total libertad de negarse a que yo suba al avión, pero la aerolínea convalidó y así fue como llegué a Berlín muy emocionado y contento”, aseguró, y agregó que la entrada a Alemania se dio sin problemas porque “tiene una regulación que nos acompaña más que otros países”.
Tras su viaje por varios países europeos llevando marihuana medicinal, Liebman afirmó que “es importante antes de cruzar una frontera con cannabis averiguar, avisar a las autoridades del país y esperar la respuesta”.
“Si bien puede ser legal, los momentos que se pasan frente a un policía pueden ser incómodos y pueden despertar reacciones impensadas, aunque es totalmente injusto que todavía estemos sometidos a este sistema”, advirtió.
Por último, Liebman destacó que las regulaciones que se están aplicando sobre el cannabis en Argentina “son de avanzada“, y aseguró que hay que continuar desarrollando una industria nacional de la planta.
“Hay mucho interés del sector en invertir en Argentina, las empresas quieren desembarcar en el país. Tenemos que proteger la industria nacional y aprovechar el conocimiento de los cultivadores que desde hace años vienen trabajando”, afirmó.
“Los avances en la regulación del cannabis en Argentina son muy buenos, estamos en un camino que nos falta mucho por atravesar pero estamos encaminados. Tenemos una legislación mucho más avanzada que España o Uruguay, donde a los cultivadores y consumidores medicinales de thc se los termina persiguiendo. Hay que entender que el acceso al cannabis es salud y, como salud, es un derecho“, concluyó Liebman.
