A un año de la cocaína adulterada, no quedan detenidos y piden investigar a “Mameluco” Villalba
(Por Ian Werbin) A un año de la muerte de 24 personas y la intoxicación de al menos otras 80 por el consumo de cocaína adulterada en los partidos bonaerenses de San Martín, Tres de Febrero y Hurlingham, no quedan detenidos ni imputados en la causa y solo sigue vigente un pedido de la Justicia para que se investigue la presunta vinculación con el caso de la organización liderada por el capo narco Miguel Ángel “Mameluco” Villalba, quien está preso por otros hechos.
En un fallo del pasado 25 de octubre al que obtuvo acceso Télam, la Sala II de la Cámara Federal de San Martín dictó la “falta de mérito” para los cinco detenidos que había en la causa que investiga 11 de las 24 muertes ocurridas entre el 1 y 2 de febrero del año pasado, causadas por el consumo de cocaína adulterada con carfentanilo, que es 10 mil veces más potente que el fentanilo y la heroína.
Esa madrugada, casi un centenar de personas tuvieron que ser hospitalizadas producto de intoxicación de la mezcla entre el mencionado estupefaciente y el opioide, la cual había sido distribuida desde el interior del asentamiento Puerta 8, del partido de Tres de Febrero.
Debido a la masiva intoxicación, el Ministerio de Salud provincial emitió un “alerta epidemiológica” ante “la identificación de casos con signos de shock, depresión del sensorio, dificultad respiratoria, excitación psicomotriz, y que presentan antecedentes de consumo reciente de cocaína” en establecimientos de salud de los municipios de Hurlingham, San Martín, Tres de Febrero, Morón, Tigre, Ituzaingó y General Rodríguez.
Incluso, el ministro de Seguridad provincial, Sergio Berni, instó a quienes habían comprado estupefacientes durante esas 24 horas a que “descarten la droga” y apuntó al sospechoso Joaquín Aquino (33), alias “El Paisa”, como presunto líder de la banda que distribuyó la cocaína adulterada.
Un día después, “El Paisa” fue detenido por disposición del fiscal federal de San Martín, Paul Starc, aunque un vocero judicial explicó a Télam que durante los meses siguientes Aquino “fue desligado de la investigación ya que no hubo ni hay ningún elemento para asociarlo a los casos de cocaína adulterada”.
A pesar de ello, Aquino permanece alojado en la Unidad 28 del Servicio Penitenciario Federal (SPF), ubicada en los tribunales de Lavalle 1337, en la Ciudad Autónoma de Buenos Aires, como acusado de liderar una banda narco que operaba en la zona de Villa Loyola, Villa Sarmiento y Villa 18, todas en el partido de San Martín.
En tanto, por las muertes causadas por la cocaína adulterada quedaron detenidos inicialmente Iván David Avalos (21), Nicolás Matías Campos (18), Luis Alberto Rodríguez (26), Mauricio Adrián Balcarce (29) y Héctor Gabriel Faundez (47).
Los cinco fueron acusados por el delito de “homicidio agravado por el uso de veneno como método insidioso” por el juez de San Martín Mariano Grammático Mazzari, quien ordenó la prisión preventiva al considerar que “formaban parte de una organización criminal vinculada al narcotráfico” que había distribuido la droga adulterada desde el interior del Puerta 8.
Un mes después, la causa pasó a la Justicia Federal y quedó a cargo de la jueza Alicia Vence y del fiscal Starc.
Finalmente, en octubre de 2022, los camaristas de la Sala II de la Cámara Federal de San Martín decidieron sobreseer a los imputados al revisar el pedido de prisión preventiva ya que “la prueba reunida no avaló en forma suficiente la tesitura de que los justiciables hubieren tenido en sus manos el curso causal de los acontecimientos”.
Los jueces Alberto Agustín Lugones, Marcos Morán y Néstor Pablo Barral explicaron que “los acusados no fueron identificados entre los agentes que contribuían a la faena criminal dentro del esquema asociativo en los distintos turnos del punto de venta emplazado en el barrio Puerta 8″.
A pesar de lo cual, los magistrados no descartaron que Ávalos, Campos, Rodríguez, Balcarce y Faundez tengan algún tipo de vínculo con el búnker y el lugar de acopio de la droga, aunque manifestaron que “no son condición suficiente para la producción de los resultados penalmente relevantes”.
Al respecto, la esposa de uno de los sobreseídos, Gabriel Faundez, dijo a Télam que “la causa contra él estaba armada”.
“Esto fue armado por la policía. Nosotros no tenemos nada que ver. Para mí se equivocaron de allanamiento“, expresó Verónica, quien agregó que su esposo continúa detenido en el penal de Ezeiza, pero por otra causa ligada a la “tenencia de estupefacientes”.
Por su parte, los camaristas Lugones, Morán y Barral pidieron en su resolución que se investigue a la banda liderada desde la cárcel por “Mameluco” Villalba, haciendo referencia a una serie de escuchas telefónicas que lo vinculan con la distribución de la cocaína adulterada.
“Algunos miembros de la organización coliderada por Iván y Miguel Villalba conocerían los efectos de la novedosa composición de alcaloides debido a que fue testeada en dos personas del entorno que resultaron hospitalizadas. A la vez, se registran profusos diálogos suscitados en forma ulterior a que la remesa ilícita fuera comercializada”, apuntaron.
En dichas escuchas, “Mameluco” habla desde su celda del penal federal de Rawson, donde se encuentra cumpliendo una pena de 27 años de prisión por lavado de dinero y narcotráfico.
Durante la charla telefónica hace referencia a “la droga fea“, en las cuales reconoce que los presuntos integrantes de su banda “hicieron cagadas y la sacaron a la venta” y que “tiraron todo a la cancha lo que estaba para descartar”.
Fuentes judiciales señalaron a Télam que Villalba todavía no fue formalmente imputado por las muertes ocasionadas por la cocaína adulterada ya que está siendo investigado en otra causa por comercialización de estupefacientes por la jueza Vence.
Por otro lado, durante esta semana se registraron dos casos de cocaína adulterada en la provincia de Santa Fe, cuando dos jóvenes fueron atendidos en la misma localidad con cuadros de fiebre alta asociado a lesiones cutáneas y en mucosa yugal poco tiempo después de consumir el estupefaciente.
Según señalaron los voceros, la cocaína fue adulterada con levamisol, una sustancia que es utilizada como antiparasitario de uso veterinario, por lo que el Ministerio de Salud local emitió un alerta hacia los centros de salud del sistema público.
